Terms of Use

1. Acceptance of Terms

By accessing and using Juggle Tracker ("the Platform," "we," "our," or "us"), you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our service.

These terms apply to all users worldwide, including New Zealand users, and constitute a legally binding agreement between you and Juggle Tracker.

2. Description of Service

Juggle Tracker is a web-based platform that allows users to:

  • Log and track football juggling sessions
  • View personal statistics and progress over time
  • Compete on global, national, and team leaderboards
  • Join teams and clubs
  • Receive AI-powered coaching tips and technique improvement suggestions
  • Compare performance with other players

3. User Accounts

3.1 Registration

To use certain features of the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account

3.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.

3.3 Age Requirements

Users under 13 years old (or under 16 in the European Economic Area) must obtain parental or guardian consent before using the Platform.

4. User Conduct

You agree not to:

  • Use the Platform for any illegal or unauthorized purpose
  • Submit false, misleading, or fraudulent juggling session data
  • Harass, abuse, or harm other users
  • Attempt to gain unauthorized access to the Platform or other users' accounts
  • Use automated scripts, bots, or other means to manipulate data or rankings
  • Reverse engineer, decompile, or attempt to extract source code from the Platform
  • Upload viruses, malware, or any malicious code
  • Violate any applicable local, national, or international laws

5. Data Accuracy and Fair Play

Juggle Tracker operates on an honor system. Users are expected to log accurate juggling session data. We reserve the right to:

  • Review and verify suspicious activity or data
  • Remove or adjust data that appears fraudulent or manipulated
  • Suspend or terminate accounts that violate fair play principles

6. Leaderboards and Public Information

By using the Platform, you acknowledge that certain information will be publicly visible on leaderboards, including:

  • Your name
  • Country and city (if provided)
  • Juggling statistics and rankings
  • Team and club affiliations

You may adjust your privacy settings or delete your account if you wish to remove this information.

7. Intellectual Property

7.1 Platform Ownership

All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of Juggle Tracker and are protected by copyright, trademark, and other intellectual property laws.

7.2 User Content

You retain ownership of the data you submit (juggling session records). By submitting data, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and process your data to provide and improve the service.

8. AI-Powered Features

Our Platform uses artificial intelligence to provide personalized coaching tips and technique improvement suggestions. These suggestions are for informational purposes only and should not be considered professional coaching advice. We are not liable for any injuries or outcomes resulting from following AI-generated suggestions.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Platform will be uninterrupted, secure, or error-free
  • Data will be accurate, complete, or reliable
  • Defects will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUGGLE TRACKER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

For New Zealand Users: Nothing in these terms excludes, restricts, or modifies any guarantee, warranty, term, or condition, right, or remedy implied or imposed by the Consumer Guarantees Act 1993 or any other applicable New Zealand consumer protection legislation that cannot lawfully be excluded.

11. Indemnification

You agree to indemnify, defend, and hold harmless Juggle Tracker, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Platform or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe:

  • Violates these Terms of Use
  • Is harmful to other users or the Platform
  • Exposes us to legal liability

You may terminate your account at any time by contacting us or using the account deletion feature.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.

13.2 Dispute Resolution

For New Zealand users, any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.

For international users, disputes shall be resolved through binding arbitration in accordance with the rules of the International Chamber of Commerce (ICC).

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Juggle Tracker regarding the use of the Platform.
